These Terms of Use (“Terms”) govern your access to and use of the Vita Meridian website, the WeighCal mobile application, and related services (collectively, the “Services”) provided by Vita Meridian LLC (“Vita Meridian,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.
You may use the Services only if you can form a binding contract under applicable law. If you are under 18, you may use the Services only with the involvement of a parent or legal guardian.
You may use the Services only in compliance with applicable law and these Terms. You agree not to misuse, interfere with, disrupt, or attempt unauthorized access to the Services, other user accounts, or related systems or networks.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activities that occur under your account. You agree to provide accurate information and to notify us promptly if you believe your account has been accessed without authorization.
WeighCal is intended to support general wellness, habit tracking, and informational purposes only. The Services do not provide medical advice, diagnosis, or treatment and are not a substitute for professional medical advice or care. Always seek the advice of a qualified healthcare professional regarding medical questions.
If you choose to enable step tracking, the WeighCal app may request permission to read your step count from Apple Health. Step tracking is optional, and you may disable Health access at any time in Apple Health or iOS Settings.
We use Apple Health step count data only to provide app features such as daily step progress, charts, goals, and user-requested exports. We do not use Apple Health data for advertising, tracking, data brokerage, or sale to third parties.
If you enable Apple Health write sync, WeighCal may write weight, sleep, and water entries to Apple’s Health store on your device. Write sync is optional for each data type. You can disable write access at any time via iOS Settings → Health → Data Access & Devices → WeighCal.
Step counts and related activity summaries are provided for general wellness and self-tracking purposes only. They may be incomplete, delayed, inaccurate, or unavailable depending on your device, Apple Health settings, permissions, and data sources. You should not rely on the app for medical decisions, emergency use, diagnosis, or treatment.
Certain WeighCal Pro features require a paid auto-renewable subscription purchased through Apple In-App Purchase in the iOS app. Available subscription options may include monthly and annual plans.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You may manage or cancel subscriptions through your Apple ID subscription settings.
Refunds are handled by Apple in accordance with Apple’s policies. Vita Meridian does not issue direct App Store refunds except where required by law.
Current pricing, subscription duration, and billing terms are shown in the app before purchase and may vary by country or region.
WeighCal requires account sign-in before starting a subscription purchase or restore so your subscription entitlement can be linked to your account and restored across supported devices.
You can restore eligible App Store purchases in the app using Restore Purchases after signing in to your WeighCal account.
You retain ownership of the information and content you submit to the Services, subject to any rights needed for us to operate, maintain, and improve the Services. You are responsible for the accuracy and legality of the content you provide.
The Services, including their software, design, branding, logos, text, graphics, and other content, are owned by Vita Meridian LLC or its licensors and are protected by applicable intellectual property and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works based on the Services.

The Services may rely on or link to third-party services, products, or websites. We are not responsible for third-party services and your use of them may be governed by separate terms and privacy policies.

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Vita Meridian LLC and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenues, or goodwill, arising out of or related to your use of or inability to use the Services.
We may suspend or terminate access to the Services if you violate these Terms or if necessary to protect the Services, users, or applicable legal rights.
We may modify the Services or these Terms from time to time. When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Services after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles, except to the extent superseded by applicable law.
